Resolution on the Right of Refusal and Religious Accommodation
As adopted at ADL's annual meeting of the National Commission on November15, 2008

The Anti-Defamation League encourages religious accommodation by employers and business owners for their employees so long as such religious accommodation does not infringe upon the rights of others or result in an undue hardship for the employer.

Consistent with this policy, ADL believes that policies or laws that are designed or have the effect of using religious accommodation to foster actions that adversely impact, if not infringe upon, the rights of others should be discouraged and rejected.

Therefore, while recognizing the right of an individual pharmacist to exercise conscientious refusal, based on his or her religious beliefs, to fill prescriptions for medications or treatments that compromise that pharmacist’s religious beliefs, ADL strongly opposes policies or laws that permit a pharmacist to interfere with the physician-patient relationship by refusing to fill such prescriptions and to return the original prescription to the patient without simultaneously offering a referral source to the patient so that his or her medication can be promptly and timely obtained without undue delay or burden.  This allows the pharmacist to “step aside” but not “step away” from his or her professional responsibilities.

ADL opposes policies or laws that allow government officials to refuse, for religious reasons, to issue same-sex marriage licenses in a jurisdiction in which same-sex marriage is legal; and ADL opposes policies or laws that allow government officials to refuse, for religious reasons, to perform civil marriages of same-sex couples in a jurisdiction in which same-sex marriage is legal unless such policies or laws provide for immediate access to other government officials able and willing to perform such civil marriages free of discrimination.
